1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of Quidger, including its mobile application, website, AI-powered tools and related services collectively referred to as the "Service".

The Service is provided by TubeOnAI ("Quidger", "we", "us" or "our").

By downloading, accessing or using Quidger, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Quidger independently.

If you are below the age of legal majority where you live, you may use Quidger only with permission from a parent or legal guardian. The parent or guardian is responsible for the minor's use of the Service.

You may not use the Service if applicable law prohibits you from doing so.

3. Accounts

Some Quidger features may require an account.

You agree to:

• provide accurate account information;
• keep your login credentials confidential;
• promptly update outdated information;
• protect access to your device and account; and
• notify us if you suspect unauthorized access.

You are responsible for activity performed through your account unless caused by our failure to use reasonable security measures.

You may not create accounts through automated means or impersonate another person or organisation.

4. The Quidger Service

Quidger may allow users to:

• upload PDF documents;
• paste text;
• submit supported links;
• generate quizzes using artificial intelligence;
• answer multiple-choice questions;
• receive explanations;
• review incorrect answers;
• save quizzes and study history;
• use supported languages; and
• access other learning features we introduce.

Features may vary by device, operating system, country, subscription plan or app version.

We may modify, improve, suspend or discontinue features where reasonably necessary.

5. AI-Generated Content

Quidger uses automated systems and artificial intelligence.

You understand and agree that:

• generated questions, answers and explanations may be inaccurate;
• AI output may omit relevant information;
• similar or identical output may be produced for other users;
• output may not be suitable for your intended purpose;
• Quidger does not replace qualified teachers or professional advisers; and
• you are responsible for reviewing and verifying generated content before relying on it.

You must not rely exclusively on Quidger for examinations, medical decisions, legal matters, financial decisions, safety-critical information or other high-risk purposes.

Quidger does not guarantee the factual accuracy, originality, completeness or educational suitability of AI-generated output.

6. User Content

"User Content" means files, text, links, prompts, quiz materials, feedback and other content you submit to Quidger.

You retain ownership of your User Content.

You grant us a limited, non-exclusive, worldwide licence to host, copy, process, transmit, display and otherwise use User Content solely as necessary to:

• operate the Service;
• generate requested quizzes or explanations;
• save and synchronise your content;
• prevent abuse;
• provide support; and
• improve the Service as described in the Privacy Policy.

This licence ends when the relevant User Content is deleted, except where temporary backup retention, legal obligations or security requirements apply.

7. Your Responsibilities for Content

You represent and warrant that:

• you own your User Content or have permission to use it;
• your submission does not violate copyright, privacy or other rights;
• you are authorised to process any personal information contained in it;
• your content does not violate applicable law; and
• your use of the Service complies with third-party platform terms.

You should not upload:

• confidential business information;
• government identification documents;
• financial-account credentials;
• medical records;
• passwords;
• private information about other people;
• examination material you are prohibited from sharing; or
• any sensitive information not necessary to use Quidger.

8. Copyright and Intellectual Property

The Service, excluding User Content, is owned by or licensed to Quidger.

This includes:

• software;
• source code;
• designs;
• graphics;
• branding;
• logos;
• interface elements;
• databases;
• documentation; and
• original content provided by us.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to use Quidger for personal and lawful educational purposes.

You may not:

• copy or redistribute the application;
• sell, rent, sublicense or commercially exploit the Service;
• reverse engineer or attempt to extract source code, except where law permits;
• remove copyright, trademark or ownership notices;
• use our branding without permission;
• scrape or systematically extract content;
• use automated tools to overload or access the Service; or
• use Quidger to develop or train a competing product without written permission.

9. Acceptable Use

You must not use Quidger to:

• violate laws or regulations;
• infringe intellectual-property rights;
• upload unlawful, defamatory or fraudulent material;
• generate or distribute malware;
• bypass security or access restrictions;
• interfere with servers, networks or other users;
• probe or test vulnerabilities without permission;
• create deceptive academic submissions;
• impersonate another person;
• harass, threaten or exploit others;
• process content involving child sexual exploitation;
• generate instructions intended to facilitate serious wrongdoing;
• submit excessive automated requests; or
• use the Service in any way that could harm Quidger or its users.

We may remove content, restrict features or suspend accounts where we reasonably believe these Terms have been violated.

10. Academic Integrity

Quidger is designed to support learning, revision and knowledge assessment.

You are responsible for following:

• your school's academic-integrity rules;
• your teacher's instructions;
• examination regulations;
• workplace confidentiality obligations; and
• copyright restrictions.

You must not present AI-generated work as your own where disclosure is required.

We are not responsible for disciplinary action resulting from misuse of the Service.

11. YouTube and Third-Party Sources

Quidger may allow you to submit links to third-party content, including YouTube videos.

You agree that:

• you will only submit links or content you are permitted to use;
• availability depends on the third-party service;
• a third party may remove or restrict content;
• Quidger is not responsible for third-party material; and
• use of third-party services remains subject to their terms.

Quidger is not affiliated with or endorsed by YouTube unless expressly stated.

12. Free Features, Subscriptions and Purchases

Quidger may offer free and paid features.

Paid access may be offered through:

• recurring subscriptions;
• one-time purchases;
• promotional trials; or
• usage-based plans.

Prices and available plans will be shown before purchase.

Purchases made through Apple App Store or Google Play are processed by the relevant store and are subject to its payment terms.

Unless otherwise stated:

• subscriptions renew automatically;
• renewal occurs unless cancelled before the end of the current billing period;
• the applicable store charges the payment method connected to your store account;
• you can manage or cancel subscriptions through your Apple or Google account settings; and
• deleting the Quidger app or your Quidger account may not automatically cancel an active store subscription.

Refund eligibility is determined by applicable law and the rules of the store that processed the purchase.

Free trials

Where a free trial is offered:

• eligibility may be limited;
• unused trial periods may be forfeited when a paid subscription begins;
• the subscription may renew automatically when the trial ends; and
• you must cancel through the relevant store before the trial ends to avoid being charged.

13. Promotional Offers

Promotional offers may be subject to separate eligibility requirements, duration limits and terms.

We may modify or withdraw an offer where permitted by law, but changes will not retroactively alter a completed purchase.

14. Feedback

When you submit suggestions, ideas or feedback, you grant us permission to use that feedback without restriction or payment.

This does not transfer ownership of your unrelated User Content.

15. Availability and Updates

We aim to keep Quidger available, but we do not guarantee uninterrupted or error-free access.

The Service may be unavailable because of:

• maintenance;
• technical failures;
• internet outages;
• third-party provider failures;
• security incidents;
• legal requirements; or
• events outside our reasonable control.

You may need to install updates to continue using the Service.

16. Suspension and Termination

You may stop using Quidger at any time.

We may suspend or terminate access where reasonably necessary because:

• you materially violate these Terms;
• your use creates security or legal risk;
• payment is overdue or reversed;
• your account appears fraudulent;
• we are required to do so by law; or
• the Service is discontinued.

Where reasonable, we will provide notice and an opportunity to correct the issue.

Upon termination:

• your right to use the Service ends;
• some stored content may be deleted;
• provisions intended to survive termination will remain effective; and
• active subscriptions must still be cancelled through the relevant store.

17. Account Deletion

You may request account deletion through settings.

Deletion is handled according to the Privacy Policy.

Certain information may be retained where required for legal compliance, fraud prevention, security, payment records or dispute resolution.

18. Disclaimer of Warranties

To the fullest extent permitted by law, Quidger is provided on an "as is" and "as available" basis.

We do not guarantee that:

• generated content will be accurate;
• every file or link will process successfully;
• quizzes will meet a particular curriculum;
• the Service will always be available;
• errors will always be corrected;
• content will never be lost; or
• use of Quidger will produce a particular academic result.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

19. Limitation of Liability

To the fullest extent permitted by law, Quidger and its owners, employees, contractors and service providers will not be liable for indirect, incidental, special, consequential or punitive losses arising from the Service.

This may include loss of:

• data;
• profits;
• opportunity;
• goodwill;
• academic results; or
• access to content.

Where liability cannot be excluded, our total liability relating to the Service will not exceed the greater of:

• the amount you paid to Quidger during the 12 months before the event giving rise to the claim; or
• £50.

This limitation does not apply where liability cannot be limited under applicable law, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence.

20. Indemnity

To the extent permitted by law, you agree to reimburse us for losses, claims and reasonable costs arising from:

• your unlawful use of Quidger;
• your User Content;
• your infringement of third-party rights; or
• your material breach of these Terms.

This section does not apply to the extent a claim was caused by our own breach, negligence or unlawful conduct.

21. Changes to the Service or Terms

We may update these Terms to reflect:

• changes to Quidger;
• legal or regulatory requirements;
• security issues;
• new features; or
• changes to business practices.

We will provide reasonable notice of material changes where required.

Your continued use after revised Terms become effective constitutes acceptance, except where applicable law requires express consent.

22. Governing Law and Disputes

These Terms are governed by the laws of the United States of America, without regard to conflict-of-law rules.

Courts located in the United States will have jurisdiction, unless mandatory consumer law gives you the right to bring a claim elsewhere.

Before filing a formal claim, you agree to contact us at support@tubeonai.com and attempt to resolve the matter informally for at least 30 days.

23. General Provisions

If any provision is found unenforceable, the remaining provisions remain effective.

Our failure to enforce a provision is not a waiver.

You may not transfer your rights under these Terms without our permission. We may transfer our rights as part of a merger, reorganisation, financing or sale of the business.

These Terms and the Privacy Policy constitute the agreement between you and us concerning Quidger, except where additional feature-specific terms apply.
